The offer of this online store is proposed by Astrum Evo company, based in Via degli Emiri, 38F, 90135 – Palermo, VAT number 07165250825, in accordance with the current rules for electronic commerce and distance contracts contained in the Consumer Code D. Lgs. 6 September 2005.
By placing an order on the online shop www.astrumevo.com (“Website”) the final consumer (“Client”) declares to have read all the information provided during the purchase process, and to accept in full the general conditions and payment as set out below. The customer also declares that he has the legal capacity to commit himself according to the provisions of these general conditions.

Products information

Product information and features are available at www.astrumevo.com. The photographic representation is normally the image used for the presentation of the product for sale, but cannot be considered as a representation of its characteristics and qualities.

Prices and characteristics

The prices of the Products published on the Website are expressed in Euros and must be understood to include 4%, 10% or 22% VAT depending on the type of product. They do not include any delivery charges, which will be indicated in the order confirmation. The price guaranteed to the buyer is that published on the Site. The price becomes definitive at the time of execution of the order. The prices of the Products published on the Site time by time cancel and replace the previous ones and they are subject to the actual availability of the Products.

Orders and invoicing

Once the purchase order has been submitted, the customer will receive an e-mail from Astrum Evo confirming receipt of the purchase order and containing information on the main characteristics of the product purchased:

• Detailed price indication;
• Delivery costs;
• Applicable taxes;
• Payment methods.

Following the approval of Decree-Law n. 223 “Maneuver bis” art. 37 comms 8 and 9, converted by Law 248 of 4 August 2006, which entered into force on 12 August 2006, whereby the obligation to communicate the list of customers and suppliers in case of issuing invoices is restored, and the Decree-Law 78 of 31 May 2010 converted into Law 122 of 30 July 2010, imposes the need to request customers to communicate any VAT number and tax code in the appropriate fields on the site.

Each order of Products sent to Astrum Evo constitutes a contractual proposal by the Customer. For the emission of the invoice, the information provided by the Customer at the time of the order is decisive. No change in invoice will be possible, after the issue of the same. Astrum Evo cannot be held responsible for errors in the delivery due to inaccuracies or incompleteness in completing the purchase order by the customer. Astrum Evo may not be held liable for any damage to the products after delivery to the carrier responsible for their transport as well as delays in delivery to the latter.

Acceptance of order

The fulfilment of the order by Astrum Evo is equivalent to confirmation and acceptance of the same. The correct receipt of the order is confirmed by the e-commerce system through an e-mail response, sent to the e-mail address provided by the Customer. This confirmation message will include the date and time of the order, an “Order Number” and a “Customer Code”, to be used in any further communication.

Availability of products

The order will be executed within the terms specified on the Site. In case of non-execution of the order by Astrum Evo (if it is due to unavailability of the products ordered by the Customer), we will inform the Customer as soon as possible of the expected delivery time for the supply of the missing product. If the Customer does not want to wait any longer, Astrum Evo will refund the amount already paid by them for the non-performed delivery. In case of stock exhaustion or unavailability of the ordered product, Astrum Evo will inform the Customer as soon as possible, specifying a deadline for availability. The Customer will confirm through the e-mail indicated at the time of order his choice, that is to wait for the availability of the Product or request a refund.

Method of payment

The customer can make the payment due by choosing one of the following ways:

• Online payment by credit card;
• Payment by bank transfer.

Shipping methods

Given the nature of the goods, we always pay the utmost attention in order management. After choosing the most suitable packaging, we ensure the safety of the lots and entrust them to the courier. Our customers can track the progress of the shipment and the status of the order thanks to the Tracking Number that Astrum Evo sends as soon as it is known by the courier who manages the delivery.

Delivery time

Shipments are made throughout Italy and abroad. The delivery time is around 24/72 hours from the moment of entrustment of the goods to the courier. Orders are processed within 5 working days from the order confirmation. In some cases there may be delays in delivery of the order due to delivery in deprived areas or for internal management problems at the courier company; in this case we could not be held responsible but we will undertake to request the courier to make the delivery as soon as possible. In any case, the customer will always be warned.

Right of withdrawal

The right of withdrawal is exercised by sending, within 14 days from the delivery of the product, a written notification by registered letter with acknowledgement of receipt to our address. The notice of withdrawal may be sent, within the same period, also by e-mail to info@astrumevo.eu .
The customer is required to return the product to Astrum Evo within 14 (fourteen) working days from receipt of authorization for return. The date of dispatch of the authorisation shall be deemed to be the date on which it is sent.

Delivery

When the goods are delivered by the courier, the Customer is required to check:

• the number of packages delivered corresponds to that indicated in the transport document;
• that the packaging is intact, not damaged or otherwise altered, even in the closing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or product or mismatch of the number of packages or indications, must be immediately disputed.

Applicable law and jurisdiction

The sales contract between the Customer and Astrum Evo is concluded in Italy and governed by Italian law. For the resolution of civil disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the underogable territorial jurisdiction shall be that of the court of reference of his municipality of residence or domicile, if located in the territory of the State; in all other cases, the territorial jurisdiction is exclusively that of the Court of Palermo. In accordance with and for the purposes of articles 1341 and 1342 of the Civil Code, the Customer declares that he has carefully read and understood and specifically accepts all the terms of the General Conditions of Sale.

Processing of personal data

Astrum Evo in accordance with art. 13 of DLgs 196/2003 and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, as well as the free movement of such data, informs that personal data and tax, provided directly by the interested parties, or otherwise acquired in the scope of the Company’s activity, will be processed in compliance with the legislation referred to, including the confidentiality obligations set out therein.
